General Terms and Conditions

Article 1: Purpose

These general conditions define the respective obligations of the company member of the "CAMPING PARADIS" network CAMPING PARADIS LA GINESTE, a public secondary establishment company, presented by its general manager Nicolas GANDON (hereinafter the " Campsite ") and of the customer (hereinafter referred to as the " Customer (s)") in the context of the sale of stay(s) by the Campsite on the website https:// www.campings-paradis.com/france/arnac/camping-paradis-la-gineste (hereinafter referred to as the " Website ") or any other marketing support made available to Customers. The purpose
of these general conditions of sale (hereinafter referred to as the " GTC ") is to define the rights and obligations of the parties in the context of the rental of
camping pitches (hereinafter referred to as " Pitch(s) ") and/or rental accommodation (hereinafter referred to as " Accommodation (s)") within the Campsite.

Article 2: Acceptance of the general conditions and internal regulations

By booking a Pitch and/or Accommodation within the Campsite, the Customer acknowledges having fully read and definitively and unreservedly accepted the General Terms and Conditions of Sale.
For an online reservation, this acceptance is formalized by ticking the box linked to the following statement: " I acknowledge having read the General Terms and Conditions of Sale ". This method of acceptance will have the same value as a handwritten signature from the Customer.
When booking through another channel (telephone or on site), the Customer acknowledges having received the internet link allowing access to the General Terms and Conditions with their booking documents and having accepted them, it being recalled that they are always accessible and downloadable from the Website.
The Customer undertakes to consult the internal regulations of the Campsite (hereinafter referred to as the " Internal Regulations ") and to comply with them.

Article 3: Reservation

  • Booking conditions
Reservations can only be validated by an adult with legal capacity.
The Customer agrees to book a stay in their own name and on their own behalf and to occupy the selected Accommodation or Camping Pitch for the duration of the stay. Minors must be accompanied by their parents or legal guardians.
 
  • Booking terms and conditions
The booking terms are as follows:
  • On site
  • By phone at 04.71.62.91.90
The Customer may place an option on an Accommodation or a Pitch by telephone by contacting the following number: 04.71.62.91.90.
When this option is placed, the Campsite will send the General Terms and Conditions to the Customer in PDF format in order to obtain their agreement.

This option is only valid for a period of 10 days from the Customer's receipt of the option contract, after which the option will be removed by the Campsite.
If the Customer confirms their option and pays the Deposit requested by the Campsite within the time limit using the payment methods referred to in Article 6 of the General Terms and Conditions, the option becomes a reservation subject to the Customer receiving the confirmation email from the Campsite at the email address they have provided.
  • On the Campsite Website:
The Customer can make a reservation on the Website and create an account. The Customer selects the Accommodation or Pitch based on the availability offered by the Campsite.
In the event of a reservation made online, the reservation only has contractual value upon actual payment of the Deposit and upon receipt of a written reservation confirmation, by email, summarizing all the information relating to the stay.
In the event that the balance of the Accommodation is not paid within thirty (30) days before the Customer's arrival, the stay is considered canceled and the cancellation conditions described below apply.
 
  • Payment for the reservation

Any firm reservation request from the Client is broken down as follows:

Camping location:

  • Deposit of 30% of the amount of the stay + administration fees + cancellation insurance (optional);
  • The balance of the stay must be paid no later than the day of arrival. If the balance is not paid within the specified timeframe, it will be considered cancelled and our cancellation conditions described below will apply.

Rental accommodation:

  • Deposit of 30% of the amount of the stay + administration fees + cancellation insurance (optional);
  • The balance of your stay must be paid no later than 30 days before your arrival. If the balance is not paid within the specified timeframe, it will be considered cancelled and our cancellation conditions described below will apply.
The reservation is only legally binding upon receipt by the Customer of a registration confirmation issued by the Campsite by email, summarizing all the information relating to the stay.
In the event that the balance is not paid within the specified timeframe, it will be considered canceled and our cancellation conditions described below will apply.
 
  • Participants in the stay
 
  • Group booking
  Any participant in the stay, regardless of age, is considered an occupant for the purposes of capacity rules, including babies and young children.
 
  • Customers – Minors
For safety reasons, minors unaccompanied by their legal guardians for the entire duration of their stay are not accepted in the Campsites.
 
  • Maximum capacity
For safety and security reasons, it is imperative to respect the maximum capacity authorized for each Accommodation or reserved Pitch.
If, upon your arrival, it is found that the number of occupants exceeds the maximum capacity defined for the Accommodation or reserved Pitch, the Campsite reserves the right to refuse access to it, without the possibility of reimbursement for the reserved stay.

Article 4: Absence of the right of withdrawal

In accordance with Article L.221-28 of the Consumer Code, the Campsite informs its customers that the sale of accommodation services provided on a specific date, or according to a specific frequency, is not subject to the provisions relating to the 14-day withdrawal period.

Article 5: Service

  • Location
This is a bare Pitch intended to accommodate the Client's tent, or their caravan or camper van.
The price of the Client's stay is calculated based on a basic package for 1 to 2 people and beyond, determined based on the number of participants (hereinafter referred to as the " Price ").
The maximum capacity is 6 people.
The Price includes the rental of the Pitch on which the Client may install, at their choice but not cumulatively :
  • a tent + a vehicle, OR
  • a caravan + a vehicle, OR
  • a camper van.
The Rate also includes access to reception facilities, entertainment, and restrooms, and, depending on the package chosen, a connection to the electricity network, or other options.
Additional costs (additional person, additional vehicle, pets, etc.) are not included in the Rate and will be added to it.
 
  • Accommodation
Rental accommodations are fully equipped.
The basic package is for 2 to 6 people (including babies) depending on the type of accommodation.
The campsite reserves the right to refuse access to the campsite to groups or families arriving with a number of participants exceeding the capacity of the rented accommodation.

Article 6: Rates, tourist tax & eco-participation

  • Rates
The applicable price will be set according to the rate in effect at the time of booking.
Prices indicated are expressed in euros [€] and include all taxes [TTC] and do not include tourist tax, local taxes and any additional charges. Any change or modification of the rate as well as any change in taxes applicable to the stay, on the invoice date, may be reflected in the price of the stay. The Campsite reserves the right to adjust its rates in the event of a change in the tax rate or that of VAT (10%).
Regardless of the formula adopted (Pitch or Accommodation), additional fees may be charged for additional people, additional vehicles, additional tents, animals, visitors.
 
  • Application of dynamic pricing
The Company applies dynamic pricing [price adjustment based on changes in demand]. As a result, prices are subject to change, both upwards and downwards.
Thus, it is possible that for the same stay, Customers may have paid different prices.
Customers who paid the highest price will not be entitled to a refund of the difference between the price applicable to them and the promotional price or the lower price that another customer may have benefited from under dynamic pricing.
 
  • Tourist tax & eco-participation
A tourist tax collected for the Commune of Arnac is payable upon arrival by the Client, per night and per person over 18 years old.
An eco-participation is payable upon arrival by the Client, per night and per person. The Campsite is subject to taxes on the extraction of natural resources (clean water) and
waste treatment (waste water, household waste, etc.). This is therefore a budgetary impact with a compensation and awareness value of €0.50/person/night.
 
  • Booking fees
The application fee is 23 euros for Accommodation and 23 euros for a Pitch.

Article 7: Payment

  • Deposit and deadlines
For reservations made more than 30 days before the start date of the stay, a deposit of 30% of the price of the reserved services must be paid upon booking. The balance must be paid no later than 30 days before the start date of the stay at the campsite.
For reservations made less than 30 days before the start date of the stay, full payment must be made at the time of booking.  
  • Failure to comply with payment conditions
Furthermore, the Service Provider reserves the right, in the event of non-compliance with the payment conditions set out above, to suspend or cancel the provision of the Services ordered by the Client and/or to suspend the performance of its obligations.
 
  • Accepted payment methods
For both the deposit and the balance, the payment methods available are as follows:
  • bank card (Carte Bleue, VISA, or Mastercard) online on the Website (secure payment)
The Customer's credit card information is fully protected and SSL encrypted via the Paybox secure payment platform. The Company will not be able to access the Customer's card number under any circumstances, except to obtain payment for the order.
 
  • national or international bank transfer; IBAN: FR76 1007 1150 0000 0020 0097 615 BIC: TRPUFRP1
 
  • bank check;
  • French postal check;
 
  • ANCV paper holiday vouchers and ANCV connected.
If this payment method is used, the Holiday Vouchers must be duly completed and sent to the Campsite, by registered letter with acknowledgment of receipt and by sending a "declared value" to the following address: Camping Paradis La Gineste, 15150 Arnac. The holiday vouchers must be returned with their original stubs, all detached from the checkbook and not stapled or attached to any support, taped to any support. The " Name of the holder " field must be completed.

Otherwise, the Campsite declines all responsibility in the event of loss or theft during the delivery of the Customer's payment.

Article 8: Cancellation and modifications

  • Modification or cancellation by the Customer

It is reminded that the Customer does not benefit from the right of withdrawal in accordance with article L221-28-12 of the Consumer Code.
Any request to modify or cancel the stay must be sent to the Campsite by email to contact@village-vacances-cantal.com or by registered letter with
acknowledgment of receipt to the following address: Camping Paradis La Gineste, 15150 Arnac.
The Customer may request the modification of his stay in the same campsite (dates, type of accommodation). Provided that it is possible.

Without prejudice to the fact that the full payment of the balance is due before departure, any modification at the request of the Customer is possible and may incur modification fees.
Any request for modifications must be confirmed in writing by the Customer and remains subject to availability and acceptance by the Campsite. In the event that the Customer wishes to extend his stay, the current rate will be applied. Any change made by the Customer, from a higher range to a lower range, will not give rise to any refund.

Any request by the Customer to reduce the length of their stay is considered a partial cancellation and will be subject to the terms and conditions for cancellation and interruption of stay. Cancellation or modification of the stay will result in the Campsite charging at least the following fees:
Beyond 30 days before the start of the stay 30% of the price of the stay + administration fees + insurance costs (if
taken out)
From 30 days to less than 30 days before the start of the stay 100% of the price of the stay + administration fees + insurance costs (if
taken out)
 
  • Modification or cancellation by the Campsite
In the event of cancellation of the Customer's stay by the Campsite for a reason not falling under force majeure, according to the definition resulting from established case law, the Campsite will notify the Customer as soon as possible, by email.

The Campsite will make its best efforts to offer the Customer an alternative solution.
In the absence of an alternative solution approved by the Customer, the sums paid will be fully refunded within 72 hours.

Article 9: Cancellation insurance

Article 8: Stay

  • Arrival
    • Locations: arrivals are from 4 p.m.;
    • Accommodation: The Client will be welcomed from 4 p.m. on the day of arrival. Upon handing over the keys to the Accommodation, a security deposit will be requested from the Client.
  • Departure
On the departure date indicated on the Client's contract, the Accommodation and/or Pitch must be vacated before 10 a.m. For any delayed departure, the Campsite reserves the right to charge an additional day at the current nightly rate.
 
  • Unused benefits
Any stay interrupted, shortened (late arrival, early departure), or in the event of no-show at the campsite due to the Client will not give rise to any reimbursement of said service.
 
  • Security deposit
A security deposit, the amount of which is defined in the conditions available on the Website, will be requested from the Customer on the day of arrival at the Campsite. This deposit will be returned to the Customer at the end of the stay and/or at the latest within eight days by mail from the date of departure, subject to the return of the Accommodation/Pitch in good condition and clean.

The Campsite reserves the right to retain part or all of this deposit in the event of damage to the Accommodation, the Pitch and/or its contents and/or the equipment on the campsite.
The Campsite also reserves the right to deduct from the security deposit the amount corresponding to the missing equipment and/or cleaning costs if this has not been properly carried out upon departure.
 
  • Accommodation / Pitch: It is imperative that the Accommodation and Pitch rented are returned in their original condition. In the event of damage being found (breakage, missing parts, deterioration), the Campsite will inform the Customer in advance, and then reserves the right to debit the amounts necessary to restore the condition of the rental.
  • Cleaning/Final Cleaning: Upon departure, the Accommodation and/or Pitch must be left in a suitable state of cleanliness (floor cleaned, dishes washed, blankets put away, bins emptied, cupboards clean, kitchens and bathrooms/toilets cleaned). If the Customer notices any anomalies upon arrival, they must inform the Campsite in writing within 24 hours, so that immediate action can be taken to resolve this difficulty. Without this notification, their claim cannot be responded to. In the event of failure to comply with the obligation to return the Accommodation and/or Pitch in a good state of cleanliness at the end of their stay, the Campsite reserves the right to charge the Customer a cleaning fee of a minimum value of €120 including VAT and to deduct this from their security deposit, after having notified the Customer in advance.
  • Cleaning service: The Customer has the option of opting for an end-of-stay cleaning service, which will be billed specifically. The cost of this service will depend on the category of their Accommodation. Choosing this cleaning option does not exempt them from the obligation to maintain a minimum level of cleanliness in the Accommodation by disposing of all rubbish, emptying the bins, washing dishes, and folding up blankets as a sign of respect for the Campsite's maintenance teams.
  • Other types of security deposit: a security deposit may be required for barbecue rental, bicycle rental, provision of badges for use
of the barrier, or any other special service.
 
  • Responsibility

In accordance with current legislation (Article 1952 of the Civil Code), the sale of tourist stays does not fall within the scope of hoteliers' liability.

Consequently, the Campsite cannot be held liable in the event of loss, forgetfulness, theft or damage to personal belongings, particularly in the Accommodation, on the Pitch, common areas and adjoining car parks.

The Customer is responsible for the security of their Accommodation / Pitch during their stay and is responsible for ensuring this. Certain precautions can prevent the Customer from any potential inconvenience, in particular: closing doors, bay windows, and windows before leaving the premises.
 
  • Unavailability of certain services

The services and facilities offered (swimming pool, restaurant, activities, entertainment, etc.) may not be available all year round, particularly for climatic reasons or
in the event of force majeure, or may not operate at all times of the year. They may therefore be temporarily unavailable during all or part of the Customer's stay.
Any difficulty relating to these services for a reason beyond the control of the Campsite will not give rise to a refund or reduction in the price of the stay. The Campsite will make its best efforts to inform the Customer of any work or improvements undertaken during their stay.
  • Termination of the reservation contract in the event of a breach by the Client

The reservation contract will be automatically terminated due to the Client's fault in one of the following situations:
  • If the Customer does not arrive at the campsite within 24 hours of the start of the stay , without justification or notification of arrival. The Campsite will then consider that the Customer has given up their accommodation after the 24-hour period. The total amount paid will be retained, if applicable, and no refund will be made.
  • In the event of repeated violations , i.e. if the Customer or their companions break the rules after having received an email warning requiring them to comply with the Internal Regulations, the Campsite reserves the right to terminate the stay contract with immediate effect. In such cases, the Customer will be required to leave their Accommodation and/or Pitch within three hours of the termination of their contract, which will be notified by email. No refund from the Campsite will be made.

Article 9: Internal regulations

The Customer undertakes to read the Campsite's Internal Regulations before arrival. He acknowledges that these Internal Regulations will govern his stay in addition to the General Terms and Conditions.

These Internal Regulations are posted at the entrance to the establishment and at reception.
During the stay, the Customer undertakes to respect the Internal Regulations and to ensure that the people residing with him and/or his visitors, who are under his responsibility, respect them.

In the event of non-compliance with the Internal Regulations, the Campsite will have the authority to enforce them and, if necessary, adopt all necessary sanctions, up to and including the exclusion of the Customer from the campsite
without reimbursement of the price of the stay.

Article 10: Visitors

Visitors are allowed into the campsite after checking in at the campsite reception and paying the visitor fee. Visitors will have access to the campsite's facilities, with the exception of the aquatic areas.

Article 11: Animals

Pets are welcome (except for Category 1 and 2 dogs) for a fee payable at the time of booking. They must be kept on a leash at all times. They are prohibited around swimming pools, in food stores, and in buildings. Vaccination records for dogs and cats must be up to date.

Article 12: Authorization to reproduce and distribute the image

The Campsite, during the Customer's stay, may be required to take photographs and/or make videos within the campsite for entertainment and/or communication purposes, on any media, on which the Customer and the people accompanying him/her may appear.

By accepting the General Terms and Conditions, the Customer is presumed to authorize the Campsite to use the photos and/or videos in which he/she appears for the aforementioned purposes. He/she guarantees this authorization by the people accompanying him/her. Any specific refusal must be notified in writing to the Campsite.

The Customer or one of the people accompanying him/her may request at any time, within a reasonable time, the removal, on which he/she is recognizable by sending a written request to the Campsite.

Article 14: Complaints - Disputes

Any complaint from a Customer relating to a difficulty during the stay must be notified in a precise manner by registered letter with acknowledgment of receipt to the Campsite no later than twenty (20) days after the end of the stay by writing to the following address: Camping Paradis La Gineste, 15150 ARNAC or by e-mail to contact@village-vacances-cantal.com. A copy of the complaint may be sent by the Customer to the Campsite.
Furthermore, when a non-conformity in the execution of the services of the contract is noted on site, the Customer is required to report it to reception, within 24 hours, by telephone on 04.71.62.91.90 with written confirmation, by e-mail to contact@village-vacances-cantal.com or by post to Camping Paradis La Gineste, 15150 ARNAC.

Any request for file review must be made in writing by the Customer within 14 days following the response sent by email or post by the Campsite, failing which the file will be considered closed.
  • In the event of disagreement with the Campsite regarding the handling of the complaint, and less than one year after the Customer has made a written complaint to the Campsite, the Customer will have the possibility of using the mediation services available at Arnac Town Hall.
The Customer may send their mediation request to the ARNAC Town Hall electronically: mairiearnac@wanadoo.fr
Mediation is free of charge, except for the costs of a lawyer, expert or any other person that the Customer chooses to involve in the mediation.

The European Commission has also set up a dispute resolution platform intended to collect any consumer complaints following an online purchase in order to then forward them to the competent national mediators.

Article 15: Applicable law and competent jurisdiction

The General Terms and Conditions are governed by French law.
The General Terms and Conditions were written in French and may be translated into different language versions.
For their interpretation in the event of a dispute, only the French text shall be deemed authoritative; the translated versions are provided for information purposes.

In the event that one of the clauses of the General Terms and Conditions is declared null and void, this shall in no way affect the validity and compliance with the other clauses, which shall remain fully applicable.
Any dispute or challenge to which they may give rise, whether for their validity, interpretation, execution or termination, shall be brought by the most
diligent party before the French courts, regardless of the Client's country of origin, except for provisions of public policy.

Article 16: Personal data

The processing of personal data that the Campsite implements for the purposes of the reservation is governed by the Personal Data Protection Charter available on the Website.
